These Terms of Use and Privacy Policy (collectively, this "Agreement") govern your access to and use of the Drive Colorado website and its associated pass and highway websites (collectively, the "Service"). By using the Service, you agree to be bound by this Agreement. If you do not agree, do not use the Service.

1. Terms of Use

1.1 Purpose of the Service

Drive Colorado provides access to publicly available data related to road conditions, closures, and traffic information sourced from the Colorado Department of Transportation (CDOT) and other third-party public sources. This data is repackaged for ease of viewing but is provided "as is" without any guarantees regarding accuracy, completeness, or timeliness.

The following individual websites also use this data to track specific mountain passes and highways:

While these individual websites ("Partner Sites") use data aggregated by Drive Colorado, they are separate entities. Each Partner Site operates independently, and Drive Colorado does not assume responsibility for the content or accuracy of any Partner Site.

1.3 No Affiliation with CDOT

Drive Colorado is an independent service and is not affiliated with, endorsed by, or sponsored by the Colorado Department of Transportation (CDOT) or any other government entity. While we use publicly available data provided by CDOT, including through their public API, we are not an official part of CDOT or any government agency.

Users should always verify critical information — such as road closures and conditions — through official CDOT channels for the most authoritative and up-to-date information.

The Service allows users to submit firsthand reports about road conditions, closures, and traffic disruptions. This user-generated content is clearly differentiated from official CDOT data in the interface.

While Drive Colorado encourages users to share timely and accurate information, we cannot verify the accuracy of every submission. Drive Colorado is not responsible for user-submitted content and assumes no liability for any inaccuracies or misinformation. All user-submitted content is subject to review and may be flagged, removed, or modified at Drive Colorado's discretion if deemed inappropriate, irrelevant, or incorrect.

2. Liability Disclaimer

2.1 Data Accuracy

All data on the Service comes from publicly available sources, including CDOT. While we strive to present this data accurately, Drive Colorado makes no warranties or representations regarding its accuracy, completeness, or reliability. All information is provided "as is," and Drive Colorado assumes no responsibility for errors, omissions, or inconsistencies.

2.2 No Liability for User-Generated Data

Drive Colorado is not liable for any user-submitted content, including reports on road conditions, closures, or incidents. Users are encouraged to independently verify any information before acting upon it. Drive Colorado does not validate or authenticate first-hand user submissions and is not responsible for any consequences arising from inaccuracies in user-reported information.

2.3 Camera Feeds

The Service may display live or archived camera feeds for traffic monitoring purposes. These feeds are provided by third-party sources (including CDOT) and are not controlled by Drive Colorado. We cannot guarantee that camera images are current or operational at all times. Drive Colorado is not liable for any discrepancies, outdated images, or malfunctioning feeds.

2.4 General Liability

To the fullest extent permitted by law, Drive Colorado and its affiliates, employees, contractors, and partners shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of the Service, including but not limited to reliance on data accuracy, service interruptions, or technical issues. By using the Service, you assume all risks associated with relying on the data or user-generated content.

3.2 No Third-Party Advertising or Behavioral Tracking

We do not use third-party advertising networks, behavioral tracking pixels, or analytics platforms that share your data with advertisers. We do not sell your personal information.

The Service uses TomTom and Apple MapKit APIs to display traffic flow and map data. These services operate against fixed route coordinates defined by Drive Colorado — your device's location is never accessed or transmitted. Requests to these APIs may include anonymized usage data consistent with TomTom's privacy policy and Apple's privacy policy. We do not share your account identity with either service.

No method of transmission over the internet is 100% secure, and Drive Colorado cannot guarantee absolute security. In the event of a data breach affecting your personal information, we will notify you as required by applicable law.

3.9 Camera Feeds and Privacy

Live and archived camera feeds displayed on the Service may capture public roadways and areas. These feeds are not intended to collect personal information about individuals. Drive Colorado does not control these feeds and does not collect any personal data from them.

3.10 Children's Privacy

The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us and we will delete it promptly.

4. Data Usage Policy

4.1 Prohibition of Unauthorized Use

The data, content, and materials available on the Service are the property of Drive Colorado and are protected under applicable copyright, trademark, and intellectual property laws. Any unauthorized use — including reproduction, redistribution, or scraping of data — is strictly prohibited.

4.2 Prohibition of Web Scraping and Automated Access

Web scraping, data mining, or the use of automated tools to extract data from the Service without prior written permission from Drive Colorado is forbidden. Attempts to access content using bots, crawlers, or similar tools may result in immediate blocking of the associated IP address.

4.3 Restriction on Iframe Embedding

Embedding Drive Colorado or any of its Partner Sites, or any part of their content, within an iframe on another website without explicit written consent from Drive Colorado is prohibited. Unauthorized iframe embedding may result in immediate blocking of the associated domain and further legal action.

Drive Colorado reserves the right to alter the appearance, behavior, or content of pages displayed in unauthorized iframes, or to block such embeddings entirely without prior notice.

4.4 Monitoring and Enforcement

Drive Colorado actively monitors activity on the Service. We reserve the right to block IP addresses and users that violate these terms without notice. Any misuse, illegal activity, or unauthorized access may result in legal action. We reserve the right to seek damages and take further legal steps as necessary to protect our intellectual property.

5. Modifications to This Agreement

Drive Colorado reserves the right to modify, update, or change this Agreement at any time at our discretion. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify registered users by email. Your continued use of the Service after changes are posted constitutes your acceptance of the revised terms.

6. Legal Disclaimer for Donations

Drive Colorado is not a registered 501(c)(3) nonprofit organization. Donations made to Drive Colorado are not tax-deductible under U.S. law. All funds received will be used for development, hosting, and domain costs. We are committed to transparency in our financial practices. By making a donation, you acknowledge that you understand and agree to these terms.
